A jury convicted Kimmel of capital murder in February 2000 and sentenced him to death. The Texas Court of Criminal Appeals affirmed the conviction and sentence in November 2001. All of his subsequent appeals in state and federal court were denied.

Derek Murphy was convicted of capital murder and sentenced to life in prison.

At his execution, Kimmel declined to make a last statement. After the lethal injection was started, he looked briefly at the victims' relatives, then closed his eyes. He was pronounced dead at 6:18 p.m.
